Section 4 of The 14th Amenment reads "The validity of the public debt of The Unired States, authorized by law including debts incurred for payments of pensions......shall NOT be questioned."

Some legal scholars have said the president can invoke the the above clause of the 14th Amenment to keep the nation from defaulting on the debt. Top democrats are reviving the argument that the White House could invoke the 14th Amenment of the constitution to raise the debt cealing WITHOUT congressional approval. If Obama, who itaught constitutional law, interprets this clause of the 14th Ammewnment to mean that the debt cealing iis unconstitutional, it is likely that the Supreme Court will refuse to hear arguments to the contrary, then presidenth will be in be able to instruct the Treasury to begin issuing new debt. Jeffrey Rosen has written in the New Republic , "individual members of congress would not have standing to sue-Congress becaise it would need to pass a joint resolution, which is unleky given Democratic control of the Senate". Unfortunately,this decision would probably set off a legal and public relations battle. Republicans claming that the president acts as if his authority has no bounds. In my opinion, this option can only be used if Congress fail to act between now and August 2nd, and if there are no further extensions on this dealine.
