Bank Wins $330 Mill. in Suit v. Cuba

The International Commercial Arbitration Court of the Russian Chamber of Commerce and Industry has upheld the legality of the claims of the International Investment Bank, in which Russia controls 58 percent, against the Central Bank of Cuba for the sum of about $330 million. The bank can now legally seize the assets of its debtor anywhere in the world, including Cuba.


The International Investment Bank, once the main bank of the socialist world, was founded in 1970 with the participation of Cuba and the other countries of the Council for Mutual Economic Assistance. It filed suit against the Cuban national bank in April of last year “for purposes of preventing debts from losing value,” since the statute of limitations had run out on several credit agreements. The International Investment Bank states that it does not plan to seize Cuban assets, however. Instead, it may sell its claims on the secondary market.

The Cuban Central Bank is not easy to pin down. It has no website and few telephones. It has been avoiding contact with the International Investment Bank for the last several years and has no representatives there. Nor did the bank participate in the court hearings in the suit against it. Sources say Cuban authorities sent a letter in June expressing their readiness to negotiate an out-of-court settlement, but took no further action.

Cuba is Russia’s largest foreign debtor. By Russian estimates, its Soviet debt is $25-26 billion. The chances of collecting that money are close to zero. Cuban authorities say that Russia owes Cuba more than $30 billion for the sudden severance of economic ties between the USSR and Cuba. The last time Russia tried to
lect money from Cuba, it was suggested that it should pay $200 million per year in rent for the use of the radar station in Lourdes, a suburb of Havana.
